Possible consequences for marijuana charge.

I was traveling from Washington to Idaho on I-84 and was pulled over for speeding (80 in a 65). I also received a possession ticket of less than an ounce of marijuana, and have to go back to court soon. I had a friend with me, and we are curious to know the possible punishments for us. This is my first offense, but he's already in trouble for an MIP. What will probably happen and is there anything else I should know being that this is my first time going to court? Thank you.

The minimum mandatory penalty for CONVICTION of possession of less than 40 grams of marijuana is 24 consecutive hours in jail and a $250 fine. The maximum penalty is 90 days in jail and $1000 fine (does not included court costs). If you are under the age of 21 years, you face a suspension of your driver's license.

In most counties, there are alternatives to pleading guilty and going to trial, e.g. continuance for dismissal with conditions such as community service or treatment. Forfeiture of bail (monetary penalty only) may be an option.

You should enter a plea of not guilty and explore your options. There may be challenges that should be raised. If you cannot afford to retain an attorney from the area in which the case was filed, apply for court-appointed counsel.
