son wants to return but scared of jail time

My son did not take care of his DUII, he left to avoid jail time because he couldn't afford the program. Now he'd like to come back, pay the fines and do community service, is that possible, or will there be jail time for sure. We were hoping for leniency as he would be turning himself in. Thank you very much. This was his first offense.

It is difficult for me to determine if he is looking at jail time from the limited info you gave me. You need to contact an attorney and give specific information regarding your son's case.

Generally, it is always better to turn yourself in, than to be brought in via warrant.
