ex=spouse w/px custody of child and who pays medical bills after ins kicks in

when a father carries med ins and pays child support and the ex-wife has physical custody of the child-she takes child to hosp for x-rays--now bills and questions regarding the visit occur(father did not know the child has been to er) who should those bills and questionaires go to-the parent who has px custody and took the child to er or the father?

The bills go to mom. She can submit to insurance company, or send to dad and he can submit them to the insuarnce company (assuming the hospital has not already done so).

Questions can be directed by either parent to the hospital or to the insurance company.

ORS 107.154 says that:

"Unless otherwise ordered by the court, an order of sole custody to one parent shall not deprive the

other parent of the following authority: To consult with any person who may provide care or treatment for the child and to inspect and receive the child�s medical, dental and psychological records, to the same extent as the custodial parent may consult with such person and inspect and receive such records."
