Legal Question in Family Law in Oregon

Parenting Time

Hi. Thanks for taking the time to answer my question. Here is my problem. According to the parenting guideline, I had my boys ( ages 15 and 12) from December 19th untill the 25th at 10am. She has them untill they go back to school. She is the custodial parent. My normal weekends were the 20th and 21st and my next regular weekend will come January 3rd and 4th. She says I can't have them because its her time. The parenting report states that one parent has them from the day they get out of school for Christmas untill Christmas day at 10am and then the other parent has them untill they go back to school. If she follows this, I won't see my boys untill January 17th. My question is this. Is my ex allowed to keep the boys during my normal weekend because of the holliday parenting plan or is there some way for me to have them for my regular weekend? Otherwise I will have to wait 3 weeks to see them. Thank You.

Re: Parenting Time

In allocating parenting time, the general rule as applied by most judges is that specific holidays take precedence over vacations times, and vacation times shall take precedence over weekend and midweek parenting time.

So for this time around, you won't see your boys until January 17th. But at ages 15 and 12, most likely they will survive without any lasting and permanent damage. And keep in mind the adage that "What goes around comes aroung." Check the calendar and see how things will work out in future years.
