Legal Question in Immigration Law in Oregon

EB3 visa application

I am a tourist here in US and had successfully found an employer to petition me for an immigrant visa. But the problem is I am only allowed to stay until December of this year. So I am thinking of going back to my country on November. Is it advisable to file first at the Immigration the application before i go back to my country or is it better for me to go back first to my country before we file the EB3 visa application? Will there be a difference?

Re: EB3 visa application

It does not make any difference. For EB3, the earlier you file, the earlier your priority date, which means less waiting.
