Legal Question in Legal Ethics in Oregon

Responding to a summons

How do I properly respond to a summons to appear in a civil action. I must submit an ''answer'' to the court clerk but I am unsure of format and substance needed.

Re: Responding to a summons

Your question is a good reason why you NEED AN ATTORNEY. You have left out so many questions that it is clear you cannot handle this on your own because you do not know what it is you need to know.

I am not belittling your lack of legal sophistication but pointing out that what you don't know can kill you.

For example you failed to say if you are in state court or federal court, what kind of case it is, why you were served a summons without a complaint.

You also need to get a hold of a State form book and see the State rules.

While being sued is never fun, and it sucks to have to pay out money to defend something you didn't do, you must put that aside and get to a lawyer quickly so as to preserve any rights you may have.

Good Luck.
