Legal Question in Medical Malpractice in Oregon

My daughter went to her doctor with severe headaches, dizziness and nausea. The doctor diagnosed her with low blood pressure, adjusted her meds, sent her home. Two days later, she went back to the doctor because the headaches and dizziness was worse. The doctor diagnosed her with an ear infection. Two days later, my daughter passed away. Do I have a legal case?
