Legal Question in Personal Injury in Oregon

personal injury defense

I was in a minor fender bender with someone 1 1/2yrs ago. He is now claiming injuries that MAY be in extent of my Bodily insurance limits. My insurance wants me to sign giving permission to disclose my limits. Should I do this? Is my insurance company trying to pull one over on me?

Re: personal injury defense

Depends. Do you have extensive personal assets? If NOT, it's usually in your best interests to allow the plaintiff to determine your policy limits. If you refuse to, they can sue you and then they get to find out anyway.

If you DO have substantial personal assets -- and I'd urge you to VISIT with a personal injury lawyer on these important details -- then it's a tougher question, and more may turn on exactly HOW badly injured the plaintiff was.

The one thing I can tell you -- and I'm NO FAN of insurance companies -- is that I doubt they're trying to pull anything. They've most likely been asked to disclose your policy limits by the plaintiff's lawyer or the plaintiff. Talk it over with the adjuster assigned to your case. Find out just how seriously hurt the other party really is.

Good luck to you. -- Sam
