Legal Question in Personal Injury in Oregon

Question about rearend settlement.

I was rear-ended about 4 months ago and suffered from whiplash. I have undergone physical therapy, had an M.R.I and X-rays taken. The results of the M.R.I show that I have a slightly bulged disk in my lower neck. My doctor bills total around 3000 dollars. I am a college athlete an have been affected by my injury. The insurance claim representative wants to settle and I have no clue as to how much money I should settle for. What is a good ballpark estimate to start at in this situation?

Re: Question about rearend settlement.

It is probably too early to consider settlement. The answer to value is dependant on whether you are medically stationary, whether the disc bulge is provably caused by this accident, and, if so, whether the bulge is clinically signifcant, and whether you have a temporary or permanent injury. Ultimately the value is based upon what you think a jury would give you in the county where any possible litigation would occur. Juries are more generous in some counties than others.
