Legal Question in Wills and Trusts in Oregon

Father without will

My Father passed away recently and left no will. He was remarried in Oregon for one year and I am his only daughter, and he has a step-daughter. What questions would be most applicable to ask a probate attorney?

Re: Father without will

Start by learning where your father was domiciled at the time of his death. If he was in Oregon, you need to consult an Oregon probate attorney.

If he was domiciled in WA, his wife is entitled to take the community property and one half the separate property and you are entitled to the other half of his separate property in the event that he did not have a will. This is not as straightforward as it sounds, though.

Probate in WA is simple and easy. Most probate attorneys will want to do a consult before committing to getting involved.

You might want to look at avvo.com (a v v o) to see if you can locate a local attorney who can assist you.

Hope this helps. Elizabeth Powell
