Legal Question in Wills and Trusts in Oregon

Finding out who the beneficiary is on my husbands IRA

My husband had an IRA. He died in Dec. and forgot to put me as beneficiary. His two adult sons are 25% ea. The company he had the IRA with will not tell me who the other beneficiary is. There is a trust and I was supposed to liquidate the IRA and distribute the money accordingly. What now?

Re: Finding out who the beneficiary is on my husbands IRA

If the institution holding the IRA won't tell you who is the 50% beneficiary it may be because it has either concluded that it's not the trust and therefore you don't need to know, or because it hasn't been provided adequate proof of your role as the successor trustee of your husband's trust.

The latter should be an easy fix, if it's the former, you may need to discuss it with an attorney if you believe that there is something wrong with the designation (undue influence, etc.) and want to challenge it in court.
