removing adminstrator

My sister is administrator of my mother's estate in Oregon. She has not provided us with an accounting of expenses, and failed to pay water bill resulting in water being shut off. Low estate balance is suspicious. Can we have her removed as admin.? Can we request itemized accounting of expenses?

If you believe that the administrator (Oregon uses the term personal representative ("PR")) of an estate is not doing the job properly, it is sometimes possible to have that person removed. Mere failure to pay a water bill is probably not enough, but it could be a sign of larger problems. Removal of the PR requires a showing that the person is not handling the estate properly (i.e., is taking the estate's assets for personal use).

You do not say how long the estate has been open. Oregon law requires that the PR provide an inventory of the estate's assets within 90 days of appointment. Then, annually, or upon the closing of the estate, the PR must provide an accounting of the estate's assets, including copies of the canceled checks.
