Legal Question in Family Law in Pennsylvania

When is a child emancipated?

My daughter had a baby at age 16. I still take total responsiblity of her and did not go to court to have her emancipated. She attends high school full time. Her father said that he no longer has to pay child support because as soon as she had her baby she was emancipated. Is he correct?

Re: When is a child emancipated?

eighteen is legal age, unless illness and lack of ability to work. Although pop is not responsible for grandchild, real father is, pop is responsible for daughter til eighteen. Emacipation is not something the court does, it is a state of being. If she cannot take care of herself, both you and pop are responsible.

Re: When is a child emancipated?

In Pennsylvania children are emancipated either when they graduate from high school or become self-supporting. If your daughter is not capable of supporting herself, her father still has to pay child support, whether or not she has a child of her own, until she graduates high school.
