Handicap Parking

Our township has refused to allow us to have a handicap parking space in front of our home. They said they do not allow anyone to have one in the township.

You asked about a handicap parking space.

Isn't your township special, just because they don't allow anyone to have a handicap space they think that satisfies their duty? Not quite. Townships, municipalities and any other public entity or accommodation must satisfy the Americans with Disabilities Act. That means they MUST provide handicap parking where needed in amounts equivalent to the local need or state standard.

Use caution though. If the localoty can point to other alternatives then you are out of luck. SUch as if you have a parking space or driveway, then you could be denied a handicap space. Moreover, the town does not have to put the space where you would like it, and if forced to install it could put it at the most inconvenient spot possible in compliance with the law.

Finally, while a handicap space out in front of your house may look appealing, remember that that space is available to ANYONE with handicap. It is quite common for people to have fights because a handicap space in front of one person's house is used by another handicapped person.
