Legal Question in Bankruptcy in Pennsylvania

Personal debt in marriage

I am a married homemaker and my debt has gotten out of control. I owe over $30,000 dollars on my credit cards. I have no personal income. I qualifyed for the cards based on household income provided by my husband. He will not pay for this nor is he legally liable because the cards are only in my name. I am worried that I may not qualify for bankruptcy if they consider his income. We are middle class but I am not sure what the guidlines are for debt/income when it comes to filing. It certainly is leaving us strapped finacially and it is ruining our marriage. Even with all this debt, I have no real property that could be given up under Chapter 7. Any advice? Thanks mom143

Re: Personal debt in marriage

It is true that your husband's income will be considered to determine if you are elegible. To evaluate this, you should subtract from the household income all expenses, exclusive of credit card debt and personal loans. If the amount left is less than $500.00 per month, you may qualify. Otherwise, you could file a Chapter 13, but that would require some money from your husband.

You should speak to an attorney for more details and feel free to call or E-mail me on a free intial basis.
