Legal Question in Business Law in Pennsylvania

Liability of volunteer officers in an incorporated motorcycle club

Currently the officers & couple of insurance men in the membership who insist that a liability policy is necessary. Motorcycle club incorporated since 1946. Waivers are signed for all riding events. All officers & executive board members are volunteers.

While the club agrees it would be additional protection, it is felt that it is not necessary, as the club is incorporated and feel the officers are not held personally liable.

Currently the membership is split. We would like an unbiased legal view.

Re: Liability of volunteer officers in an incorporated motorcycle club

In my opinion there should be insurance coverage. Volunteers are personally liable for their negligent acts. In the best interests of all concerned, I urge you to obtain coverage. However, a full review of the circumstances must be made to give an unqualified recommendation. If I can be of any assistence please, call. Gerald Hershenson 215-579-9390
