Legal Question in Business Law in Pennsylvania

Non Compete Contracts

I work as an Account Executive for a cluster of Radio Stations selling advertising. I quit my previous job to work for this company and was informed only after hire that I was required to sign a non-compete contract. I did sign the contract. Now nine months later I have been offered a position as a Sales Manager by a cable company. I will be in no way involved in advertising, nor would the people that I will be supervising be selling advertising. They sell cable subscriptions and internet service to comsumers and businesses. My current employer has threatened to sue me for breach of my non-compete. Do I have reason to be concerned?

Re: Non Compete Contracts

Non-compete contracts can be enforceable in Pennsylvania but are narrowly and strictly construed. Factors considered are how long the restriction lasts, how far it reaches geographically, and how broad it is in covering future employment positions/duties. You should have the contract reviewed by an attorney who is familiar with this area of law.
