Legal Question in Business Law in Pennsylvania

I recently discovered an incorporated company using the exact same incorporated company name as mine. I have been incorporated for 5 years and have been incorporated on recently. I am in the U.S. and they are located in Canada. Is there any legal recourse between countries for two corporations with the same name? Thank you for your time. Brian

It all depends on how the parties have protected their names (as registered trademarks or service marks - not just corporate names), where they do business, type of industries and consumers, etc. Consult with a good trademark or franchise attorney in your area for specific advice.
