Legal Question in Civil Rights Law in Pennsylvania

age discrimination?

My mother is a 70 year old private school teacher. After 30 years, her contract was not renewed. Admin suggested that she retire. Same goes for 3 other colleagues in the same age range. No one else was let go. Is this a case of age discrimination or are private schools allowed to do this kind of thing? Thanks!

Re: age discrimination?

Your mother could have a potential claim under the ADEA (Age Discrimination in Employment Act) or under the PHRA (Pennsylvania Human Relations Act). The claim would initially depend on whether she is over 40 (which she is) and whether or not she was replaced by someone "significantly younger" than herself (which your email did not reference).

It would also be important to understand why the school claimed her contract was not being renewed.

If you would like to discuss further, please feel free to contact me. Take care.
