Cival Suits

How long do you have to file a cival suit? I moved out of living with my ex Aug 2002, he filed cival suit against me Oct 4 2004 for $16,000 saying I owed for half of all rent and utilities from May 99 TO Aug 02. His mother paid all rent and utilities and I was never to pay anything except gas was in my name which I paid. Can he still file? What do you think will happen?

It depends what he is alleging in the civil suit. From what you're saying, he may be contending that the two of you had a "contract" or quasi-contract. In such case, he has 4 years to file.

In the case of tort civil suits (for such things as negligence, etc., e.g., not based on contract theory) he would have 2 years.

Since so much is at stake, you should get an attorney. It might be possible, based on how he wrote the suit, to get it thrown out quickly. On the other hand, it may be more complicated.
