Legal Question in Technology Law in Pennsylvania

Self-employement

Dear sir/madam,

I have the plan to build a web site to advertise for people who mostly want to sell or rent things that they desire. My question to you is: Do I need a legal right to built the web site? if Yes, what is the process of having this legal right? And what I will be allowed to advertise?

Thank you for the advise.

Sincerely,

Jean Duclair

Re: Self-employement

I am not sure what you mean by the "legal" right to build the website. The rights to advertise on behalf of people would come from a contractual agreement between yourself and those people. This agreement could be in the form of a terms of use agreement on the website to which your customers would agree when joining your website.

The determination of what you'd be allowed to advertise depends upon what level of control, if any, you plan on having over your customer's ads. There are certain federal laws that shield a website operator's liability depending upon the operator's involvement with its users' content. Please contact my office if you'd like to discuss further.
