Disputing Mfr. Decision/Warranty

I bought a Stearns & Foster Mattress set from a dept. store in May '06. Prior to May '07 the mattress had body impressions 1''. I finally filed a claim just prior to May '08. However, S&F recently informed me that they will not honor the warranty due to the unsanitary condition of the mattress - one of the stipulations in the warranty (the mattress was never covered and shows some very light staining near its edge.) I paid in excess of $2500 for the set and would like to know I should pursue this matter in spite of S&F's claim. This matress' performance was worse than any other I've ever purchased at far lesser prices.

You can give it a shot; but you'll have a few hurdles. You'll have to have a rationale for the delay. You will be asked why it took so long to assert the warranty. You used it for two years even though it was the worst mattress you ever owned? These practical considerations weaken your case. You should think twice before you invest your time and money in the suit.
