Legal Question in Consumer Law in Pennsylvania

I had Home Depot install a central air conditioning unit in my home. There are cooling lines that run in my attic. At a later date I had a new roof installed. The shingles were hammered in with nails that punctured the cooling lines and cause a coolant leak. When I turned on the air this summer it didn't work.

My ac repair main explained why there was a leak and it was due to the nail holes because the lines were run too close to the attic roof.

The air unit was installed 2006 and the roof the fall of 2009. I didn't find problem till this summer when i turned it on. Would Home Depot be libel for a bad install?

The statute of limitations on a contract is 4 years. It seems to me, though, that there was a roof on the house when the lines were installed, and the roofer should have installed the new roof to avoid the lines. Were they visible to the roofer? Did you advise the roofer that the lines were there?

I'd first contact Home Depot, and just ask them to correct the problem. There is a very good chance that they will call the contractor, and have them fix it, w/o fighting with you. Two suggestions - 1) Hope for the best, and plan for the worst, and 2) anticipate the best, be reasonable, and ask before you start worrying about something being a problem. If you worry about things before you know they are a problem, you can spend your entire life worrying for nothing! That's foolish.
