when is an item considered abandonded?

i sold a backhoe on ebay almost one year ago. the buyer did pay for it in full, however, has yet to come and pick up the machine. i have been trying to get him to pick up this machine for almost a year but he always has an excuse and puts it off. i want this machine off my property and would like to know, legally, when this machine would be considered abandoned property. also, would i be entitled to storage charges?

You asked about removal of sold property.

Unfortunately you let the problem get away from you. You probably can't go back and charge storage fees retroactively.

But, you can do so going forward. As long as you provide reasonable notice. Also, you may be able to claim the property abandoned after a certain period of time (this is pretty technical and should not be done without a lawyer).

You really are better off having a lawyer prepare and send a letter to this effect to avoid any potential mistakes that could be made by the unwary.
