Legal Question in Consumer Law in Pennsylvania

Product Return/Exchange

Prior to purchasing an organic mattress, I asked the store proprietor if I could return the mattress if I had any problems with it. He told me that 'customers are responsible for return shipping so that usually deters returns'. So I clarified that I was able to return the mattress if there were any problems and he said 'yes'. There were NO signs in the store stating--name removed--return or exchange policy. There was nothing on my invoice/receipt about returns, final sales, etc. And once the product was delivered to my home, there was nothing assoicated with it that stated anyhting about returns, final sales, etc. Within 10 days of receipt of the mattress, I contacted the store and stated that I wanted to return it. It was dreadfully uncomfortable and as it turns out, it was not the specific bed listed on the invoice; it was not entirely organic-it had synthetic handles. The other proprietor then told me that there were no returns of this mattress. She said the manufacturer would pay all S&H to replace my bed with--name removed--fully organic bed--no handles or that I could simply ''cut'' the inorganic handles off!! I don't want this bed--it's terrible. I filed--name removed--credit card dispute. What are my remedies? HELP!

Re: Product Return/Exchange

You have two options...follow through with the credit card you purchased this mattress with, and / or file a civil complaint with a District Justice....in the event you choose the latter I would recommend retaining legal counsel.

If you have any questions please feel free to contact my office at your convenience.
