Legal Question in Credit and Debt Law in Pennsylvania

I have a corporation, it is not doing well and debt collectors are calling. Can a debt collector come to my place of business and take a asset inventory?

No. I generally assist consumers, not corporations, however, a creditor cannot do anything until they get a judgment against the corporation. Corporations do not have the same exemptions that people do so if the corporation does have assets the judgment creditor can seize them.

Are all these debts just in the business name? And does the business have any assets that can be seized and sold like land, buildings, money in the bank, doing a business where there is a cash register (I have heard of the sheriff going out to levy the nightly receipts of a bar owner, so it can happen). If the answer is yes, then it might make sense to consider bankruptcy for the business. If not, maybe you can simply go out of business and dissolve the corporation.

Debts can be settled, even for corporations. If you have the resources to settle, even if you need some time, I know of a company that can help.

Although I provide assistance to the consumer clients of NLS, I only do so for Georgia and PA clients. Another attorney handles North Carolina clients.

Their phone number is 1-800-728-5285; speak to the director, David Gelinas.
