Credit Card Settlement Offer

A family member (who was not

authorized for use of the credit

card), borrowed our card and ran it

up to the maximum limit. He has

discontinued making payments for

months. The credit card company

has offered us a settlement for 25%

of the debt. Knowing that the credit

card is in our name, do we have any

legal means to turn the debt over to

to the family member who incurred

the charges? Thank you for your

You asked about a credit card settlement.

As the owner of the card you are responsible for any use of the card of which you are aware. To me it sounds as if you knew this person was using your card and allowed it to go on. In that case you actually are responsible for 100% of the debt and all fees.

If the person did not have authorization then the charges are fraud and the CC company can require that you cooperate in prosecuting the individual.

Yes you can seek compensation from the individual, but your less likely to get it than the CC issuer.
