Legal Question in Credit and Debt Law in Pennsylvania

my father lost his buisness, warehouse and all contents due to unpaid mortgage from no work. he owes 18,000 for lumber and they are trying to take the home he now lives in. this home was purchased by him and another (partnership per say) he got married to this partner after they purchased this home and the lumber store has sent him certified mail that they are having a sherrif sale of the home. can they do that?? he and his wife will both be on the street for 18,000 and the home is worth much more. they are both senior citizens

It is unethical for me to discuss your father's legal problems with you. I do not know what your father signed and whether he signed some kind of personal guarantee. I do not see how his wife would be liable for debts of his business unless she also signed the guarantee. Bankruptcy will stop the sale. I suggest your father consult with a bankruptcy attorney.
