Legal Question in Credit and Debt Law in Pennsylvania

I live in the state of Pennsylvania and was sued by Nudleman, Klemm and Golub for a credit card I had but couldn't pay. It only had a few hundred dollar limit and now they quote that I ow them over $900. I received a summons for a court date next month. I panicked and called Nudleman firm and accepted an agreement to pay $75.00 a month until the $900 is paid off. I wanted to avoid going to court. Now I regret signing that agreement. What can happen to me if I don't pay Nudleman? I signed an agreement to pay. What now?

It depends on what assets you have. If you are "judgment proof" then Nudelman is not going to get anything.

The time for challenging this is pretty much over as Regardless ot the limits on the credit card, when you stopped paying, the credit card company was allowed to charge interest, late fees and over the limit fees. With court costs added in and possibly attorneys fees, I can well see how the judgment is now $900.

You should not have signed the agreement but the only thing Nudelman can do if you don't pay is exercise the same remedies under the law that they could have exercised anyway. There is no wage garnishment in PA for a credit card debt.

They will freeze your bnk account so I would look to keeping less than $300 in any one bank account at all times or look for other alternatives - going to an online bank, getting an out of state account or a pre-paid debit card.

I would start thinking about how you are going to resolve the debt because its only going to get bigger. If you can, start setting money aside - at least $50 per month or more. When you have close to $500-$750, you can then try to resolve the debt with Nudelman by way of settling.

Before you send them a dime, you need an agreement. Or you should do what you should have done before - consult a lawyer before you sign anything or do anything. I give free email consults and charge $50 for a 30-minute phone consult. I can also assist in resolving your debt for a reasonable fee. Please contact me at [email protected] if interested.
