Legal Question in Credit and Debt Law in Pennsylvania

misinformation

My college age son drove to a plastic surgeons office because he needed stitches in his forehead. Before he was treated I spoke to someone in the office and explained that my son could go the hosp. for treatment unless the office took our insurance. She assured me they did take it. The doctor was on call for the ER that night.Later they say it was incorrect info. that was given to me and they are taking me to court for the 600.00 I have not paid in over a year. I held the check from insurance for seven months and did send it to them with a letter to the doctor. They will not let me speak to Dr. and wont work it out. Do I have a chance?

Re: misinformation

That's hard to say. As a contract issue you could argue it was a mutual mistake and that you should only be liable for the amount authorized by your insurance company as payment for the actual value of the treatment. If this is before a Magisterial District Judge in a small claim type of situation then a lot depends on the particular MDJ.
