owe money to creditor

There is a collection agency that keeps trying to take me to court. I know i am guilty but i am on welfare and have two small children and i am a single mom with no job. What do i do?

You asked about annoying bill collectors.

Look on this site and on the Internet in general about the Fair Debt Collection Practices Act. Don't be afraid to assert your rights and stop their harassment.

You can consider bankruptcy but depending on your debt level it may not be necessary. If you have no assets then the collector can't get anything. Just be careful regarding any exposed assets, such a paid off vehicle, non-exempt personal items or bank accounts.

Be certain to properly document your contacts with the debt collector and if it violates the FDCPA, sue it. You can collect statutory damages AND attorney fees if you prevail. If you have kept good records many attorneys will be happy to take the FDCPA case for you.

You should contact Neighborhood Legal Services. It is important that an Answer be filed if a Complaint is filed. If they are just calling and threatening to take you to court, then you may want to get caller ID and screen your calls since they do have the right to make reasonable attempts to collect, assuming it is a genuine debt.
