Legal Question in Credit and Debt Law in Pennsylvania

Threatening letter from an Attorney

I received a letter from an attorney stating ''Legal Action is being taken'' this is in regards to an old credit card debt. The last payment on the account 03/2005. I believe this is past the Statue of Limitations. Can I still be sued for this old debt? Should I contact the attorney?

Re: Threatening letter from an Attorney

It may or may not be past the statute of limitations. Yes, they will sue you, but you should defend it. If the file has been transferred to a Collection Agency (the attorney may be working for them) then the case can be beat. Even if its the original creditor, you have many defenses available other than the Statute of Limitations. I would be glad to review the lawsuit at no cost to you, and at your convenience.

Statute of limitations is 4 years in PA. So, they likely filed just before the 4 years was up. If they file suit against you, you will need an attorney...there are usually valid defenses to these suits...feel free to contact me.
