Legal Question in Criminal Law in Pennsylvania

13 year old probabtion and confinement

Dear Sirs,

A friend of mine's 13 year old son was sentenced to 6 months confinement in a juvenile facility in Pennsylvania, for a first offense. The young man stole a mop-ed that had been left behind after the owners had moved. The owner did not file charges. The boy's mother wants to move to Kentucky to allow her son a new start. Can her son's case be transferred from Pennsylvania to Kentucky?

Thank you,

Eric Weaver

Re: 13 year old probabtion and confinement

Hi,

I find it hard to believe that on a first offense he was sentenced to a juvenile detention facility. However, you will have to petition the Court to allow a transfer, and prior to that I would contact the County Probation office in Kentucky to make sure that they will accept the transer.

In the PA petition, point out the purpose of juvenile system is to rehabilate a youthful offender not punish, and tell them the positive reasons for the transfer.
