Legal Question in Criminal Law in Pennsylvania

I really need some advise here!!

recently I was arrested for "open lewdness" at an area department store. I have never been convicted of any crimes or even traffic violations in my life and I am not guilty of the charges. I was seen by the video cameras scratching my inner leg which was mistaken for open lewdness. I reveiwed the tape with the officers and I feel it clearly shows that I was scratching my leg which I feel shows resonable doubt.

I know in my mind and heart that I did not attempt open lewdness in any way. However, it is my word against the police and store security. It is for this reason that I have begun to become concerned. I have been doing some research on a misdemeanor of the third degree and have found that I could face up to a year in prison and 2,500 dollars in fines.

I would like to fight the charges against me due to lack of evidence, but I would also like to know what your company thinks would be the punishment for a first offense of a third degree misdemeanor if I should lose my case.

Thank you

The sentence will in part depend on where you reside. As unjust as that sounds, in larger cities such as Phila. the court does not have time for cases such as this. In a more rural "family oriented" community, the judge may find the conduct warrants an "aggravated" rating on the sentencing guidelines and impose a sentence other than probation. You really should not mess with this. Get an attorney. If you are in the Phila area call for a free consultation.
