Legal Question in Criminal Law in Pennsylvania

My coworker was grocery shopping over her lunch hour. She was finishing up and decided that she also wanted to purchase one of the flowering plants located outside. She was on her way to pick up the plant then pay for her groceries when she was stopped and accused of shoplifting...

This is ridiculous. She shops there every day; she has the receipts to prove it. Can she really get a summons for this. The store called the police and a report was made.

Ultimately, yes the police can bring the charges against her if they had reason to believe there was evidence that she left the store without paying for merchandise. What your co-worker will have to show at the preliminary hearing is that there is evidence that she was intending to return inside with the plant to purchase and had no intention of not paying for the merchandise she left the store with. Unfortunately, your friend's case sounds like one in which it will be decided on credibility.
