Forgery & Receiving Stolen Property

My daughter cashed 5 checks for a so called friend and it turns out that all 5 checks were stolen and she is currently sitting in our local county jail. She only knows the nickname of this person. Does she stand any kind of chance of not getting charged for this? She already has a retail theft charge for which she is on probabtion for. These charges were brought against her in 3-2006 we just found out about them on Friday. I was tempted to contact the owner of the checking account myself but wasn't sure if that would be detrimental to her case. I ahve no faith in Public Defenders in this county all they want to do is plead her out and she had no idea that the checks were stolen in the first place. ''Friend'' said that they were from his grandma and since he didn't have any I.D. or a bank account would she be able to have his g-ma write the checks to my daughter and she would cash them for him.

If there is anything that you could recommend I would be forever greatful.

These are felony charges, and so she needs to speak with an attorney as soon as possible to plan a defense.

From what you are indicating, there are a few defenses that may be possible.

First, I would never call complaining witnesses. You can get charged with harassment, intimidation of a witness, hindering prosecution, etc. Second, depending on how the checks were made out, the case may be beatable. Third, if she is on probation, she may get a detainer and that is a whole other subject.

I would be most worried about the detainer for now.
