Legal Question in Criminal Law in Pennsylvania

Me and a friend both have the same last name and we both had the same bank. I transferred up to 8,000 into my account from his account. I had to pass security questions to do this, however, I knew enough about him to pass and get the money transferred. This was a 1,000 a time 8 times. No charges just yet and I know it was illegal, could i use the defense he game me permission? What could I be facing?

No and you are an idiot for admitting this. If he finds out this was posted here he (or law enforcement) can track you down. And why would he give you permission to take funds from his account? If he wanted you to have the money for whatever purpose, he just would have given it to you.

This is some kind of theft under 18 Pa.C.S.A. � 3921 or another of the theft statutes. This is a felony 3 (third-degree) since the amount is over $2000. 18 Pa.C.S.A. � 3903 (a.1) Felony of the third degree.--Except as provided in subsection (a), theft constitutes a felony of the third degree if the amount involved exceeds $2,000, or if the property stolen is an automobile, airplane, motorcycle, motorboat or other motor-propelled vehicle, or in the case of theft by receiving stolen property, if the receiver is in the business of buying or selling stolen property.

Since you did it 8 times, this will lead to 8 counts (8 separate offenses). If the crime is listed this way, it will be 8 separate misdemeanors under 18 Pa.C.S.A. � 3903(b) Other grades.--Theft not within subsection (a) or (a.1) of this section, constitutes a misdemeanor of the first degree.

As far as penalties go, its impossible to tell you as I do not know if you have a prior criminal history or if there are aggravating or mitigating factors. You really really need a criminal defense attorney. Maybe something can be worked out BEFORE charges are brought.
