can a person be held on a retainer with out being charged and if so for how long

I think you're asking about a detainer, not a retainer.

A detainer is when you are on probation or parole, and you are being charged with a violation of the conditions of probation or parole. You are entitled to a "Gagnon I" or preliminary hearing on the violation, and then a "Gagnon II" hearing to determine whether or not it was actually violated. There doesn't necessarily have to be another criminal charge.
