Legal Question in Criminal Law in Pennsylvania

how do i get judge to hear me?

The judge charged me two different ways for one offense... driving on a suspended license in PA. Years ago I did have 2 DUI's, but they were so long ago that they were misdomeanors at the time and they since have been dropped. I have no other offenses. I have just served 32 days in prison and even the pd office said there is no way I should be in there, yet the pd who is assigned to me is not doing anything. Judge will not even give me IPP. I am on work release. I have a great job and a great family. I am stable. Even if the judge lets me out in August at the appeal, I can't get this time back. I am scared judge is going to postpone hearing like he has the others. How can I at least get IPP or sentenced reversed ASAP rather than having to wait for appeal hearing in Aug? What can I do to have this made up to me?Thank you for help. I am going crazy. This is such an emotional heartache for my family... esp. my 13 year old son. Please advise.

DUIs are still misdemeanors. If you never got your drivers license back after the DUIs, you are probably charged with driving under DUI suspension. As for the Intermediate Punishment Program, that is up to the sentencing Judge. I'm not sure why you would be in jail pending your statutory appeal.
