Mental incompetence

If A person is of low intelligence can he or she be sentenced to a crime that mandates mandatory jail time especially if they have the mind of a child and could not fully comprehend the full extent of thier actions?

What is the offense you are referring to? There is a thing in the law where a judge can find someone not guilty based on mental capcity. It is not always the best way to go.
