Legal Question in Criminal Law in Pennsylvania

Summary Offense

Will a Summary Offense show up on a background check? Also I got written up for a Disorderly conduct, but my charge was listed as Public Drunkeness. I did not have a drink and wasnt given a breathalizer. Can I plead not guilty and have the case thrown out on the paperwork?

Re: Summary Offense

If it is a state police background check the summary offense does not show up. However, some private companies have started doing these and the summary offenses do appear online. The Magisterial District Judges dockets are public record and this creates problems for a lot of people. It is unlikely that the case would be thrown out before a Hearing.
