Legal Question in Criminal Law in Pennsylvania

underage drinking

I was recently cited for underage drinking in PA even though i blew a .006 on the breathalyzer. Last time I checked the legal limit for underage was .02. Should I even have gotten the citation?

The smell of alcohol on your breath is enough for most District Judges. You should try to get pre-trial diversion. You will probably just have to do some community service.

Re: underage drinking

The legal limit you refer to is for driving under the influence. The citation is for a different crime, that of underage drinking. Different standards apply to different acts. Sorry.
