Equal Opportunity Employment Act

I was recently at an employment agency and the staff recruiter was attempting to set up an interview for me. The potential employer asked the recruiter how old I am. Is that legal? Also, I didn't get the interview.

I don't know that it is illegal to ask a person's age for a job interview. It is illegal to discriminate against an employee because of their age, though. If you are over 40 and have some evidence that your age played a role in this decision that could be a case.
