Legal Question in DUI Law in Pennsylvania

Hi, on 7/31/2011, my car was vandalized while at a park with my fiancee. When we arrived at the car, there were 2 officers waiting for us. They asked who owned the car (I do) and tell me they are taking me into custody because they found a small amount of marijuana in the glove box (where my wallet had been stolen from!). My fiancee went with the officers, says he was never read his right, spent the night in a holding cell and was charged with possession. He must appear in court on 8/15/2011. I am trying to obtain the theft report, it is not available online and when I called the police station, they tell me it will likely take 6-8 weeks to be in the system. Any advice? Thank you.

He should contact an experienced criminal defense attorney so that his rights are protected. In certain situations, a judge may suppress evidence if Miranda is not given.

I offer free consultations if you wish to speak in more detail. I am a former DA with experience is over 7,500 criminal matters and I can be reached at 215-639-5297.
