Legal Question in DUI Law in Pennsylvania

DUI bar responsible?

My fiance received a DUI a few nights ago after a bouncer forced him to leave the parking lot even though he knew he was too drunk to drive. Can we sue the bar? Also, the cops never read him his miranda rights, Isn't that illegal? This is his first DUI. How can we get it from showing up on his record?

It's possible that a bar can be liable under the Dram Shop act for overserving. More importantly, your fiance needs to address the DUI end first.
