Legal Question in DUI Law in Pennsylvania

have a DUI in NJ from a year ago. Nothing shows up on my Pa license or insurance. Was just charged in Pa with DUI. Does the NJ offense count as a first offense in Pa? thanks

It counts if the DA finds out about it. If this is a 2nd offense within 10 years you are looking and mandatory jail time up to 90 days in jail. If you run your Penndot driving record, you will see what the DA typically sees, as NJ DUIs are traffic offenses and do not appear on your rap sheet.

I would suggest going to Penndots website and running your 10 year driver history (go to the "Driver's Services" section of Penndot's website. You should then hire an attorney quickly to look into it. If it is a 2nd offense, some counties have house arrest instead of jail.
