dui parked

parked in an off street health parking lot i was arrested for dui and charged with dui with vehicle not moving and parked is this legal

A lot depends on the facts. If the keys were in the ignition and the car was running, even if you were passed out cold, you are not going to have much of a defense. On the other hand, if the car was parked and the keys were in your pocket and you were sleeping it off after leaving a bar, you may have a shot at it.

With DUI cases there is always a question of whether or not you want to take the risk of trying a case or whether it is better to take an early plea or go ARD, if it's available, and you should talk to an attorney before you make any decision on how to proceed.
