Legal Question in DUI Law in Pennsylvania

Licence suspsnsion

I am a PA resident who just got a refusal to a chemical test charge in RI. They suspended my ability to drive in RI for 6 months. Can I still dive in PA and other states.

privilege to drive suspended in RI as a result of breathalyzer refusal- can I drive in other states?

Thank you for your Rhode Island (RI) dui / dwi/ breathalyzer refusal law question.

If you have a valid Pennslyvania license which is not suspended you can still drive in all other states except Rhode Island.

Rhode Island can only suspend your privilege to drive in rhode Island. However, Rhode Island May send the information to Pennslyvania who will then start a proceeding to suspend your license. Sometimes, Rhode Island does not transfer the info to the other state.

I strongly suggest that you speak to a Pa lawyer / attorney before you start driving to confirm this information.

Re: Licence suspsnsion

It is unclear from your post as to whether there are criminal charges pending, which I am assuming. Even if ther are not, there is reason to have concern. Both PA & RI are members of a related piece of legislation which has each state communicating with the other regarding suspensions on licenses. If my understanding of your circumstances are correct, PA can potentially recognize your suspension in RI. You should speak to attorney immediately and may contact me if you like.
