If it is within 10 years the mandatory minimum for the DUI is 5 days if under .10, 30 days if between .10 and .16 and 90 days minimum over .16. The DUS is a mandatory 90 days but the judge could run it concurrent to the DUI if he so chooses. House arrest may also be an option. I am a former Prosecutor having handled over 3,500 DUI cases. Please give me a call at 215-639-5297 and I would be more than happy to speak with you about your case. You absolutely should retain counsel due to the lengthy mandatory jail time.

You will also have your DL taken for YEARS, possibly for life. If you are driving while suspended, well I've seen that to work, but you should not risk it, but to drink and drive while suspended, you are an idiot. You need help, obviously, but to drink and drive while suspended, that has nothing to do with you having a drinking problem, it is just dumb. Get the help you need. Admitting you have a problem and actually getting help may get some pitty from the judge.
