Legal Question in DUI Law in Pennsylvania

Underage Consumption

On Saturday, I was given an underage consumption citation. I told the officer I had not had anything to drink, but because of horrific tragedies that had occured in my life, I was crying so hard I was unable to breathe correctly into the breathalizer. After yelling at me and putting me in the back of a cop car, the officer released me and told me to walk home. On Monday I found out I was given a citation for underage consumption. However, the officer wrote that I was stopped on Friday, not Saturday. I'm being told I can fight this and in all likeliness the charge will be dropped. Is this correct?

Re: Underage Consumption

Without the test he can only testify as to your appearance, your speech, and your breath. At worst with a lawyer you can probably get the citation reduced to disorderly conduct which carries no license suspension. I offer free consultations.
